Proposed changes amending Ordinance #88 will be considered for adoption by the Charter Township of AuSable Board of Trustees.

CHARTER TOWNSHIP OF AUSABLE

AN ORDINANCE TO AMEND THE AUSABLE CHARTER TOWNSHIP ZONING ORDINANCE

                THE CHARTER TOWNSHIP OF AUSABLE ORDAINS that the AuSable Charter Township Zoning Ordinance, as amended, be further amended as follows:

 

Article 18 (“   “), Section 18.02 C3 (“Keeping of Animals”), of the AuSable Charter Township Zoning Ordinance, is amended to include:  

                                                                                                                        

  3.   No person shall own or keep any animal or be in control of any animal that defecates on land

   owned by another or public land unless such owner or person in control immediately removes  

   the feces and either places it in a refuse disposal container or otherwise disposes of it at their

   own abode.

 

Article 18 (“   “), Section 18.02 C4 (“Keeping of Animals”), of the AuSable Charter Township Zoning Ordinance, is amended to include:  

 

4.   All refuse or other litter resulting from their keeping or housing shall be disposed of daily in such a manner as to prevent any nuisance or any unsanitary, odorous or offensive condition.

Article 13 (“Industrial Districts “), Section 13.01 3H (“Special Land Uses Permitted By Special Approval”), of the AuSable Charter Township Zoning Ordinance, is amended to include:  

 

H.  Residential quarters for a caretaker/security personnel, provided it is clearly accessory to the

principal use, does not occupy more than four hundred (400) square feet of space, is a legitimate  

 business and does not violate any setbacks.

Article 23 (“Landscaping and Screening “), Section 23.09 2B (“Fencing, Walls and Retaining Walls”), of the AuSable Charter Township Zoning Ordinance, is amended to include:

 

 

B.   Height

            1)   Residential Districts:  Unless otherwise specified or determined by the Planning Commission

                  or Zoning Board of Appeals, fencing and screening is to be no more than six (6) feet in height.

                   1.   Gateposts and other superstructures over site entrances and exits may be up to twelve

                        (12) feet in height.  Fencing and screening materials of a height greater than three (3) feet      

                         are not to be located within a required front setback or side setback adjacent to a street.   

                         Lot size must be 100 feet wide or more. (All measurements are from grade level)

 

             2)   Commercial and Industrial Districts Unless otherwise specified or determined by the

                   Planning Commission or Zoning Board of Appeals, fencing and screening is to be no more

                   than eight (8) feet in height.  Fencing and screening materials of a height greater than three        

                  (3) feet are not to be located within a required front setback or side setback adjacent to a

                   street. (All measurements are from grade level)
